DIALED
These Terms & Conditions ("Terms") govern your subscription to and use of Dialed, a pickleball training application and content library operated by Powers Digital Solutions ("Dialed," "we," "us," or "our"). By subscribing to or using Dialed, you agree to these Terms. If you do not agree, please do not subscribe or use the service.
1. The Service
Dialed provides drills, tips, demonstration videos, placement guidance, and progress-tracking tools to help players improve at pickleball. Content is provided for general instructional and informational purposes only. We may add, change, or remove content and features at any time.
2. Eligibility
You must be at least 18 years old to purchase a subscription. If you are under 18, you may use Dialed only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.
3. Subscription, Billing & Free Trial
Dialed is offered as a recurring subscription. Pricing and any free-trial period are shown at checkout.
- Free trial: If a free trial is offered, you will not be charged until the trial ends. Cancel before the trial ends to avoid being charged.
- Auto-renewal: Your subscription automatically renews at the end of each billing period at the then-current price, using your payment method on file, until you cancel.
- Payment: Payments are processed through our payment provider, Stripe. We do not store your full payment card details.
4. Cancellation
You may cancel at any time through the "Manage subscription" option in your account (which opens our payment provider's secure billing portal), or by contacting us. When you cancel, your access continues through the end of the period you have already paid for, and your subscription will not renew after that. We do not provide partial-period refunds except as described below or where required by law.
5. Refunds
Except where required by applicable law, subscription fees are non-refundable once a billing period has begun. If you believe you were charged in error, contact us at tchristian@powersdigitalsolutions.com and we will review your request in good faith.
6. Facility & Referral Data Sharing (please read carefully)
When you subscribe, you may be asked "Who's your club or coach?" and given the option to name the facility, club, coach, or individual who referred you.
- If you name a facility or coach, you consent to Dialed sharing certain information with that facility or coach, including: your name, the email address associated with your account, and your training progress in Dialed (the drills you have marked "working on" and "dialed in," and your placement level). This allows that facility or coach to tailor lessons, clinics, and programming and to recognize their members.
- Your payment and billing information is never shared with a facility or coach.
- Naming a facility is optional. You may choose "No club or coach — just me," and no progress data will be associated with or shared with any facility.
- You may update or remove your facility association at any time in your account under Manage account, or by contacting us at tchristian@powersdigitalsolutions.com.
- Facilities and coaches who receive this information are expected to use it only to support your development. Dialed is not responsible for a facility's or coach's independent handling of information once shared; if you have concerns, please contact us and we can remove your association.
7. Acceptable Use
Your subscription is for your personal, non-commercial use. You agree not to share your login, redistribute, copy, download for redistribution, resell, publicly display, or create derivative works from Dialed content, and not to misuse, disrupt, or attempt to gain unauthorized access to the service.
8. Intellectual Property
All content in Dialed — including videos, drills, text, graphics, and the Dialed name and branding — is owned by or licensed to Powers Digital Solutions and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to access and use the content for your own training while your subscription is active. No other rights are granted.
9. Physical Activity Disclaimer & Assumption of Risk
Pickleball and the drills and activities described in Dialed involve physical exertion and carry an inherent risk of injury. Dialed provides general instructional content only and is not medical, health, or professional coaching advice. You should consult a physician before beginning any new physical activity or training program. You participate at your own risk and are responsible for exercising within your own limits and abilities. To the fullest extent permitted by law, Powers Digital Solutions is not liable for any injury, harm, or loss resulting from your participation in activities described in Dialed.
10. Disclaimers
Dialed is provided "as is" and "as available," without warranties of any kind, express or implied, including any warranty that the content will improve your performance or that the service will be uninterrupted or error-free.
11. Limitation of Liability
To the fullest extent permitted by law, Powers Digital Solutions and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of Dialed. Our total liability for any claim relating to the service will not exceed the amount you paid to us in the twelve (12) months before the claim.
12. Changes to the Service or These Terms
We may update these Terms from time to time. Material changes will be posted here with an updated "Last updated" date, and your continued use of Dialed after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. Any dispute will be handled in the courts located in Massachusetts.
